TERMS AND CONDITIONS
1.1 The “Client” means the person/s, organisation or company booking the equipment, act or entertainment with the “Company”.
1.2 The “Company” means The EHCO Ltd.
1.3 ‘Dry’ hire is the hire of equipment for the ‘client’ to operate and supervise themselves.
1.4 ‘Wet’ hire is the hire of equipment or entertainment accompanied by a representative of the ‘company’ to supervise use of the booked equipment or entertainment.
1.5 Unless otherwise stated in writing, the terms and conditions apply to all services provided by the company. Therefore it is deemed that by placing a booking with the company (verbally or in writing), whether it is explicitly stated or not, whether the client signs to indicate their acceptance or not, the terms and conditions are binding between the two parties.
1.6. Unless otherwise agreed in writing, a deposit shall be required before a booking can be confirmed. This deposit shall be deducted from the balance payable. A booking isn’t confirmed until the company send a written confirmation.
2.1 All equipment remains the property of the company at all times.
2.2 By placing an order with us either verbally or via e-mail regardless of whether a booking form has been returned or deposit paid it is deemed that the customer has read, understood, fully agreed to and is bound by all our terms and conditions of hire.
2.3 In the event of traffic or other uncontrollable circumstances preventing us from being able to fulfil our contracted obligations our liability shall be limited to a refund of any monies paid in relation to the contracted event or a pro rata reduction in the hire fee in the event of delayed start. No further compensation will be paid irrespective of any loss of earnings.
Prices, Deposit & Balance Payments
3.1 All hires are subject to a deposit of at least 20%. Until a deposit or full payment is made, the booking cannot be confirmed and the date secured. (Deposit is non-refundable).
3.2 The balance to be paid in full and cleared at least 14 days prior to the event start date.
3.3 Terms for approved account clients will be 30 days from invoice date unless agreed in writing by the company.
3.4 Advertised prices are subject to change without prior notification.
3.5 The company reserves the right to charge interest on all overdue accounts at 2% above its banker’s current interest rate.
3.6 An idle fee may apply for extensive waiting periods.
4.1 Any cancelled order is subject to the following cancellation charges
– Within 14 days of scheduled hire date there will be no refund
– Outside of 14 days of scheduled hire date, the deposit will be forfeited
4.2 The client should notify their wish to cancel a booking at the first instance available by telephone. This request should also be followed up in writing.
4.3 A booking shall only be deemed as cancelled once the company has sent confirmation of the cancellation in writing.
5.1 The Client acknowledges that it shall be responsible for any damage or loss to The EHCO’s equipment caused by any misuse of our equipment by its customers or its guests or any theft or disaster (including but not limited to fire or flooding) at the client’s event.
5.2 The EHCO will require adequate workspace. The client will be responsible for providing suitable space(s) as well as providing a standard working plug socket(s) for power to the hired equipment(s) as well as a suitable table if required.
5.3 All goods remain the property of the company at all times.
5.4 The company reserve the right to amend or alter any product specifications without prior notice.
Site Location, Facilities & Conduct
6.1 Hired equipment will be set up in one location only as agreed on arrival and will not be moved once unloaded.
6.2 The company reserve the right to refuse delivery if the venue or site is deemed to be unsuitable by our delivery personnel or if the client has failed to notify the company of any delivery obstructions such as stairs or excessive loading distances from our vehicle to the installation site. In such a case no refund will be given and the full hire fee will be due.
6.3 The client is responsible for ensuring that suitable security and crowd control measures are in place prior to start of event.
6.4 The company reserves the right to cease operation and remove hired equipment(s) from site if at any time a representative of the company feels that guests or clients conduct endangers the safety of the guests, clients, themselves or the safety of the hired equipment(s). In such cases no refund will be given and full contracted fees will be due to the company.
6.5 If the space allocated is unsuitable at the time of arrival or if the space becomes unsuitable during the duration of the hire, then the company reserve the right to cancel the hire.
6.6 In the event the venue staff or client delays access to the venue during the setup period, as agreed during the booking process, the delayed time will be taken from the hire period thereby reducing the hire time.
Liability & Insurance
7.1 The company’s liability insurance covers use of the equipment only whilst booked on ‘wet’ hire (supervised by a representative of the company).
7.2 The client agrees to indemnify the company for any damage or theft of the company’s equipment whilst on hire.
7.3 The company accept no liability for any damage or loss of personal property and or any injury arising from the use of the hired equipment.
7.4 Any equipment booked on ‘dry hire’ is not covered by the company’s insurance policy and the client is responsible for suitable insurance cover.
7.5 The company does not accept responsibility for any complaint or damages by the venue or guests due to food products contacting with clothing or other materials.
Use of Images
8.1 The client gives The EHCO permission to use images taken at their event to be used on The EHCO’s website, social media pages and for advertising and promotional purposes.
8.2 The EHCO will not use any images that are deemed unsuitable on their website or for advertising purpose and will not use any content that maybe personally damaging to the person(s).
Hiring, delivery and service
9.1 Delivery, set up and removal of the equipment are free and including in the total amount paid.
9.2 Time taken to deliver, set up and remove the equipment will be outside the rental period.
9.3 A fully trained representative of the company will be on site throughout the hire of the equipment(s) to ensure smooth running.
10.1 You agree that email and other electronic communications can be used as a long-distance means of communication and acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing.
11.1 It is not possible to amend the event date of a booking.
11.2 Therefore; unless otherwise agreed in writing, where a client wishes to change their event date from the one originally booked then this shall be treated as cancellation of the original booking subject to the cancellation terms. Once the original booking has been cancelled, the client is then able to make a new booking for the new booking date (subject to the pricing at the time the new booking is made, availability and acceptance of the new booking by the company).
Damage to our Equipment
12.1 The cost of any repairs following damages and/or losses to our equipment shall be charged as an “additional charge” to the client in the event that any part of our equipment is lost or damaged during the client’s event.
13.1 In the unlikely event that the fountain(s) should breakdown or fail to operate as a fountain, the system will still allow the guests to dip food into the fountain bowl as required.
13.2 The quantities of dipping items provided by the Company is dependent on accurate guest numbers being advised by the Client. If these numbers are incorrect, no liability will be accepted for any decision to shorten the dipping time due to non-availability of dipping items or to simply not set up at all.
Food and Hygiene
14.1 All members handling food on behalf of the company have been trained in Food and Hygiene standards. The standards can be guaranteed by the company during the event. Any food or beverage left after the event are to be consumed entirely at the consumer’s risk.
14.2 Some of the consumable foods supplied by the company may contain nuts. Please ensure guests are aware of this. The company does not take any responsibility for any allergy problems.
14.3 The company reserves the right to close down any fountain if the contents become contaminated due to guests dipping their body parts into the fountain. There will be no refund if a fountain is closed down due to contamination.
15.1 Alcohol will not be given to anyone under the age of 18. Staff will not make exceptions. If your event includes guests around the age of 18, please ask them to bring ID.
15.2 Staff will not serve anyone who is excessively drunk, or who is abusive or threatening to staff or guests.
16.1 Any services provided by the company that is said to be ‘Unlimited’ is subject to a fair usage policy.
16.2 ‘Unlimited’ services provided is within reason and is within the stated number of guests and or hours booked.
17.1 The Client will provide parking for the Company at all times unless otherwise agreed in writing.
17.2 The parking duration includes setting up of the equipment, the event hire time and breakdown of the equipment.
17.3 The Client shall pay for parking to the Company in the event parking is not available at the event venue.
17.4 Paid parking charge is outside of the equipment hire charge.
17.5 Payment for ‘paid parking’ will be done prior to the event date.
Booking Hours, Idle Hours, Additional Hours
18.1 The Booking Hours of an event will be notified to the Company prior to the event date.
18.2 The Client will respect and not amend the Booking Hours on the event day nor will the Client ask for Additional Hours or Idle Hours whilst at the event.
18.3 Additional Hours are available for an additional fee.
18.4 Idle Hours are available for an additional fee.
18.5 Additional Hours and Idle Hours fees are charged outside of the Booking Hours charge.
18.6 Additional Hours means the equipment(s) will be in use outside of the Booking Hours for the duration of Additional Hours booked.
18.7 Idle Hours means the equipment(s) will be setup and not be available to guests or Clients for use for the duration of the Idle Hours booked.
Governing Law & Jurisdiction
19.1 The Terms and Conditions shall be governed by the laws of England and Wales and you irrevocably agree to submit to the exclusive jurisdiction of the courts of England and Wales.
